Responsibilities Consultation on complex Commonwealth and state constitutional law issues, including: Notifications under s.78B of the Judiciary Act 1903 (Cth). Conflicts between Commonwealth and state laws. Limitations on state powers, including Chapter III of the Constitution and the implied freedom of speech. Legal advice for the government on complex matters, including: Interpretation of laws in specific key areas. Significant cases of state importance. Supporting the Attorney-General in their role as First Law Officer. Advice and where necessary, representation in cases related to the application of the Human Rights Act 2019, especially regarding: Interpretation of laws and human rights-compatible administrative action. Supporting clients and the Attorney-General. Drafting compatibility statements for legislation. Collaboration with the Solicitor-General and other legal representatives in complex cases before state and federal courts. Requirements In-depth knowledge of constitutional law and human rights law.
